Please read these Terms of Service (“Terms”) carefully before using the Sale Pop application, website, or related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
Definitions
For the purposes of these Terms:
Application means the software application provided by the Company known as Sale Pop.
Affiliate means any entity that directly or indirectly controls, is controlled by, or is under common control with a party, where “control” means ownership of fifty percent (50%) or more of the voting interests.
Account means a unique account created for You to access the Service.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, Shopify policies, and these Terms.
You are solely responsible for ensuring that your use of the Service complies with applicable privacy laws and consumer protection regulations in your jurisdiction.
Content
Your Content
You retain ownership of any Content you submit or make available through the Service.
By using the Service, you grant the Company a worldwide, non-exclusive, royalty-free license to use, host, process, reproduce, and display your Content solely for the purpose of operating, maintaining, and improving the Service.
You represent that:
- You own or have permission to use the Content.
- Your Content does not violate any law or third-party rights.
Content Restrictions
You may not upload or distribute Content that:
- Is unlawful or promotes illegal activity.
- Is defamatory, abusive, hateful, discriminatory, or threatening.
- Contains spam or unauthorized advertising.
- Contains malware, viruses, or harmful code.
- Infringes intellectual property rights.
- Violates privacy or publicity rights.
- Contains false or misleading information.
We reserve the right to remove any Content that violates these Terms or applicable law.
Data and Backups
While we take reasonable measures to safeguard data, we do not guarantee that Content or data will never be lost or corrupted.
You are responsible for maintaining your own backups of important information.
We will make reasonable efforts to restore data where technically feasible but do not guarantee recovery.

Termination

You may stop using the Service at any time by uninstalling the application.
Upon termination, your right to use the Service immediately ends.
Limitation of Liability
To the maximum extent permitted by applicable law, the Company’s total liability arising out of or relating to the Service shall not exceed:
- The total fees paid by you to the Company during the twelve (12) months preceding the claim; or
- USD $100 if no fees have been paid.
In no event shall the Company be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, or data.
Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
We do not guarantee that:
- The Service will always be available.
- The Service will be uninterrupted or error-free.
- The Service will meet your specific business objectives.
- The Service will increase sales or conversions.
Any business results achieved through the use of Sale Pop depend on numerous factors outside our control.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the United States, excluding conflict of law principles.
Dispute Resolution
If you have any dispute or concern regarding the Service, you agree to first contact the Company and attempt to resolve the matter informally before pursuing legal action.
